Agent Live 360, Inc (hereinafter “Agent Live 360”) respects individual privacy and values the confidence of their customers, employees, consumers, business partners and others. Agent Live 360 strives to collect, use and disclose personal information in a manner consistent with the laws of the countries in which they do business, and pride ourselves on upholding the highest ethical standards in our business practices.

This Privacy Policy sets forth the privacy principles that Agent Live 360's follow with respect to personal information transferred from the European Union (EU) to the United States and is in accordance with the agreed upon framework (the “Privacy Shield Framework”) between the US Department of Commerce and the European Commission. Agent Live 360 complies with the EU-U.S. Privacy Shield framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries. Agent Live 360 Communications is subject to jurisdiction under the US Federal Trade Commission and has certified that they adhere to the EU-U.S. Privacy Shield framework of notice, choice, onward transfer, security, data integrity access and enforcement. When you purchase something from a store we host the checkout for, as part of the buying and selling process, we collect the personal information your customers provide us.

Section 4 - Information from our Partners

Partners are individuals or businesses who have partnered with Agent Live 360 to provide an integration or a service to the merchants who use the Agent Live 360 platform. When you register as a Agent Live 360 Partner we collect some information about your business in order to accurately present information about your business to our merchants.

Section 5 - Consent

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I access my personal information?

You retain all rights to your Personal Information and can access, amend, and correct it anytime. Both Merchants and their customers have full access to update or delete their Personal Information from the Merchant admin access or the Customer Portal. If you are unable to change any Personal Information, please contact us to make the changes. It is important to remember if you delete or limit the use of your Personal Information, the Service we provide may not function properly.

How do I withdraw my consent?

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at support@Agent Live 360.com.

Section 6 - Disclosure

We may disclose your personal information if we are required by law to do so, including to meet national security or law enforcement requirements, or if you violate our Terms of Service.

If you believe your personal Information has been used in a manner not consistent with the policies outlined, please contact us using the information provided below. If your complaint remains unresolved, you may also contact JAMS International. This organization provides independent dispute resolution services, at no charge to you. JAMS International can be contacted at https://www.jamsadr.com/eu-us-privacy-shield.

If, after attempting to resolve a dispute through JAMS International, you feel that your concerns about the use of your Personal Information have not been resolved, you may seek resolution of the issue through binding arbitration. Section 7 - Information shared with Third-Party Services

The third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to you and to us.

Certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

Agent Live 360 is responsible for all transfers of Personal Information to third parties in accordance with the EU-U.S. Privacy Shield Principles. Any Personal Information transferred to a third party for data processing is processed in accordance with our instructions, and is subject, by law, to a comparable level of protection as that provided by Agent Live 360.

Agent Live 360 will always ask for your consent before sharing your Personal Information with a Third Party for purposes other than those described in this section.

Section 8 - Security

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.

No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee the absolute security of your Personal Information.

Section 9 - Cookies

What is a cookie? A cookie is a small amount of data, which may include a unique identifier. Cookies are sent to your browser from a website and stored on your device. We assign a different cookie to each device that accesses our website.

We use cookies to recognize your device and provide you with our service and a personalized experience.

Our third-party integrations may use cookies to provide you with their service, or to serve targeted ads. You can opt out of targeted ads served via specific third party vendors by visiting the Digital Advertising Alliance’s Opt-Out page.

We may also use web beacons, tracking technology and other automated tracking methods on our websites, in communications with you, and in our products and services, to measure performance and engagement.

Section 10 - Age of Consent

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Section 11 - Changes to This Privacy Policy

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you. If this occurs, we will notify all of our merchants and customers and post on our home page.

Section 12 - This Privacy Policy Enforcement and Assessment

ENFORCEMENT: ReCharge will conduct compliance audits of its relevant privacy practices to verify adherence to this Policy. Any employee that Agent Live 360 determines is in violation of this policy will be subject to disciplinary action up to and including termination of employment. 

ASSESSMENT: Agent Live 360 will conduct an annual review to ensure adherence to the Privacy Shield framework requirements and complaint handling procedures
